The following Terms and Conditions apply to all purchase contracts made between Jan Sramek Publishing (Jan Sramek Verlag KG) and its customers.
The latest version of these Terms and Conditions shall be applicable to all orders.
By placing an order the customer accepts and agrees to the following Terms and Conditions:
The language of the contract is German but we also discuss customer issues in English and French (other than legal matters).
The customer’s order shall be a binding offer to conclude a purchase contract concerning the ordered goods. For this purpose the customer’s details are required. The customer will receive an electronic order confirmation for every order placed online. The purchase contract comes into effect either through a written or verbal order confirmation or by the shipping of the ordered goods.
The price of the ordered goods shall be the price published in the latest version of our brochures, price lists and other documents. All prices include VAT but exclude delivery charges, tariffs, etc.
Payment in full is due upon receipt of the invoice. We reserve the right to charge interest on overdue payments at the rate of 12% as is customary in the industry.
All goods shall remain the property of Jan Sramek Publishing until full payment has been received.
Any damaged goods will be replaced. The customer shall notify the consignor and all necessary steps will be taken to replace it with an undamaged copy as soon as possible. A price reduction or a substitution shall only be granted if replacement cannot be made.
Although all manuscripts are carefully chosen Jan Sramek Publishing shall not be liable for the content therein. Withdrawal from the contract due to content-related reasons shall not be admissible.
Any claims for delivery damage shall be notified to the delivery service used.
Claims for damages especially compensation for consequential damage, other indirect damage and loss or lost profits due to delayed, incomplete or failed delivery, other than personal damage, can only be filed if the damage we caused is based on gross negligence or intent.
Subscriptions to collections (journals, loose-leaf services and multi-volume editions of which not all volumes have been published) will be continued until cancelled.
The cancellation of subscriptions can only be submitted for future deliveries and shall be in writing.
Subscriptions to journals are automatically renewed after a subscription year unless we receive a written cancellation not later than six weeks before the end of that year.
Should the customer not receive an issue the customer must contact Jan Sramek Publishing within three month of the date of the issue’s publication, in order to receive a replacement copy at no extra cost.
All purchase contracts shall be subject to Austrian Law other than the application of the conflict-of-laws rule and the United Nations Convention on Contracts for the International Sale of Goods (CISG). This is also applicable to international orders and deliveries.
Unless the contract is subject to the Consumer Protection Act (KSchG) the contract shall be subject to the jurisdiction of the courts of Vienna.
If you are a consumer as defined by the Consumer Protection Act and your domicile or habitual residence is in Austria, or you are employed in Austria, the contract is subject to the jurisdiction of the court of your domicile, habitual residence or place of employment.
By placing an order the customer accepts and agrees to the use of all personal data (name, residential and delivery address, e-mail and telephone number) to ensure proper fulfilment of the contract and billing.
Details are stored for consumer support purposes and will only be passed to third parties if that contributes to the fulfilment of the contract.
The customer has the right to raise an objection to the use of the personal data at any time.
Changes and additions to these Terms and Conditions, including all contracts based upon them, shall be submitted in writing.
If individual clauses of these Terms and Conditions contradict legal regulations, such as those defined by the Consumer Protection Act, the unaffected clauses of these Terms and Conditions shall still remain valid.
